The Solicitors, however, are legally required to advise couples to resolve their matters through mediation first. This is because the courts now require proof that couples have tried to sort out their matters using mediation before seeing a solicitor.

Family Mediation Case Study

 

Mr and Mrs Burgess have three children aged 3, 6 and 11 years. Due to their marital relationship breaking down they decided to approach their solicitors to seek a divorce.

 

Their solicitors explained that the courts are encouraging parties to resolve their matters through mediation rather than through the courts and now require proof they have tried mediation. 

The couple agreed to attend mediation sessions to discuss how their property could be divided between them, the most appropriate financial arrangements to be made and the most suitable contact arrangements for their children.

 

After ‘three’ and ‘an agreement’ with ‘a Memorandum of Understanding (MOU)’. Delete the rest of that sentence. Between ‘solicitors’ and ‘seek’, insert ‘when they needed to’ mediation sessions the couple signed an agreement and applied to the court to make it a Consent Order. During the mediation process, they spoke to their solicitors to seek legal advice.
